St. Ledger-Roty Neuman & Olson, LLP’s privacy and data security practice addresses the increasingly complex web of state, federal and global laws governing the collection, use and retention of individual data. The conduct of commerce, social interactions, and delivery of government services is increasingly accomplished over the Internet, including over mobile networks via mobile applications, coinciding with the collection and storage of vast amounts of personal data across platforms and borders. Increasingly, contracts, licensing, vendor and other commercial agreements must include privacy and data protection provisions, because many commercial relationships involve the collection and storage of individual data – both on and offline.

St. Ledger-Roty Neuman & Olson, LLP attorneys assist clients with state, federal and European privacy and data protection requirements. We provide compliance guidance and risk assessment based on a client’s services, products and business objectives. Our lawyers have expertise in such areas as the Federal Communications Commission’s Customer Proprietary Network Information (CPNI) rules, which apply to wireline and wireless carriers and their affiliates; the Telecommunications Consumer Protection Act (TCPA) and CAN-SPAM rules, intended to address unsolicited telephone calls and the use of automated and pre-recorded telemarketing calls; the Children’s Online Privacy Protection Act (COPPA) Rule that applies to operators of children’s and general audience websites and online service providers; and the Federal Trade Commission’s Online Behavioral Advertising Principles that apply to advertisers and other businesses that track individual online activities for the delivery of targeted messages. Our lawyers also have expertise with the application of traditional legal principles to web 2.0 as the legal framework for protecting privacy and information continues to evolve and catch up to developments in technology.

Other areas of privacy expertise include the Federal Trade Commission’s “Red Flag” rule that applies to businesses that extend credit to their customers and the Federal Trade Commission’s Health Data Breach Notification rules that apply to vendors of personal health record products and related entities; and state and federal privacy laws pertaining to election administration and voting;. We are also familiar with EU law governing data privacy and protection, including rules governing data transfers, and pertinent safe harbor protection, partnering with appropriate EU law firms as needed.
